Terms of Service

By downloading, installing, or using Tracewise ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. Please read them — they are written in plain language.

1. What Tracewise is

Tracewise is a macOS menu-bar application that watches file-system events in folders you explicitly select, measures focus patterns, and generates invoices and weekly reports from that data. It does not read file contents. It does not capture screenshots or keystrokes.

2. Who can use it

You must be at least 16 years old and have the legal capacity to enter into a contract in your jurisdiction. By creating an account you represent that this is the case.

3. Your account

You are responsible for keeping your login credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at hello@tracewise.app if you suspect unauthorised access.

4. Subscription and billing

• The Free plan is free forever within its stated limits (2 projects, 7 days of history).
• The Solo plan is billed monthly at the price shown at checkout. Prices are in USD and exclude any applicable taxes.
• Subscriptions renew automatically. You can cancel at any time from your account settings — cancellation takes effect at the end of the current billing period.
• We do not offer refunds for partial billing periods, except where required by law.

5. Acceptable use

You agree not to:

• Reverse-engineer, decompile, or extract the source code of the app.
• Use the Service to monitor other people's computers without their explicit consent.
• Attempt to circumvent or disable any security mechanism in the Service.
• Resell or sublicence access to the Service without written permission.

6. Intellectual property

Tracewise and all related logos, wordmarks, and software are owned by us. These Terms do not grant you any ownership rights — only a limited, non-exclusive licence to use the Service as described here.

Your data (session records, invoices, project names) remains yours. We claim no ownership over it.

7. Privacy

Our Privacy Promise explains what data we collect, how we use it, and how you can delete it. It forms part of these Terms. Subscription cancellations and the 14-day guarantee are covered in our Refund Policy.

8. Disclaimers

The Service is provided "as is" without warranty of any kind. We do not guarantee that it will be uninterrupted, error-free, or that the focus scores or time estimates it produces are accurate for any legal, billing, or tax purpose. Always review your invoices before sending them to clients.

9. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising from your use of the Service is limited to the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater. We are not liable for indirect, incidental, or consequential damages.

10. Changes to these Terms

We may update these Terms from time to time. If the change is material, we will notify you by email at least 14 days before it takes effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of the Republic of Portugal, without regard to conflict-of-law principles. Disputes will be resolved in the courts of Lisbon, Portugal, unless local consumer-protection law requires otherwise.
